Total indifference and possible criminal activity:

While you read this update and consolidation keep one thing in mind. Although it has happened to me - who's next? You? And where would you turn?

Dr J. Noel [MCRN 14671] criminally negligent by wantonly denying me treatment:  

A document that stayed hidden on Dr Jacques Noel's files for a considerable time shows that by Aug 2010 he was fully aware that I'd not had the urgent treatment he claimed he had ordered 5 months previously [on 1st April 2010] for me and he was going to check this out. At that point in time I was not yet in a crippled state.

9 months later in May 2011 he told the Medical Council that he had not made the promised checks to ensure that I had the urgently need treatment and that I'd still not had treatment. He said that the hospital had not made the booking he had requested over a year ago - this was accepted by the Medical Council despite me now being crippled with extremely limited mobility, virtually housebound and in constant pain.

What Dr Noel's own documentation proves is that he was fully aware for at least 9 months that I'd not had the urgently required treatment he had ordered but he had been too lazy to do anything about it.

Constructively or otherwise he had deliberately denied me treatment / medical assistance because of his laziness. It's also proven that he falsified documentation including medical records and in any normal society that would be a criminal offence.

This would explain the extraordinary conduct of those involved, who violated and denied me my legal Rights in order to cover up for him - especially the Medical Council, who, as proven by internal documents, materially altered my complaint and evidence putting Dr Noel in the clear.

While Dr Noel's early conduct deserved a sever reprimand, his subsequent conduct merits him been struck-off as a doctor. Simply Dr J. Noel is a danger to patients.

Tallaght Hospitals' CEO Mr D. Slevin is fully aware of, and indifferent to, the very serious problems regarding his hospital's mis-treatment of me. A coroner once said that Tallaght Hospital “sounds like a very dangerous place to be for anybody, let alone a sick patient”.

The early records of Tallaght Hospital completely agree with my version of events. At later dates they 'produced' records not just contradicting my version but contradicting their own earlier records.

Another example of attempts to further shift the blame ~ the hospital call me a liar saying that I did not, as I claimed, make the very important phone call to them. They base this on a statement from Dr Noel's secretary Irene Fortune saying she never spoke to me - this despite internal documents showing she was off sick the day I phoned. I taped my call and the person I spoke to never denied taking my call.

The Medical Council's falsification proven through the Information Commissioner:

After continually insisting that they had not materially altered my complaint and evidence and that I had made the allegation, it was recorded in the Information Commissioner's legally binding decision that the Medical Council could not produce any records to show that I had made the allegation they claimed I had and they admitted that I had not made the allegation they claimed I had and they acknowledged that they had incorrectly described my complaint.

A proven serious lack of professional integrity led by President Prof. F. Wood and possible criminal activity - What confidence can one have when a doctor can leave a patient crippled for life, lodge proven falsified records with the Medical Council who actively aid that doctor by manufacturing 'evidence' and altering complaints.

The letter Dr Noel had written at the consultation - the only one received by my G.P., the only one seen by the Medical Council and the only one then in existence - completely supported my complaint by confirming he had only offered me treatment ASAP depending on when a bed became available.

Dr Noel told the Medical Council that he wanted them to accept that this letter actually confirmed that he had offered me immediate treatment and I had refused his offer.

The Medical Council agreed and they materially altered my complaint, misrepresented my evidence and indulged in falsification and dismissed my complaints - thereby putting Dr Noel and Tallaght Hospital in the clear and blaming me for my crippled state.

It's quite clear that the Medical Council acted not just against public interest and quite possibly criminally - even though I'm left crippled for life and in constant pain.

Despite this, the Medical Councils decision to dismiss 'my' complaint and clear Dr J. Noel still stands and this is explained by -

Prof. A. E. (Freddie) Wood usurps the High Court and fabricates evidence to protect Dr Noel - putting both on the same level as a common criminal:

The stated law is that the Information Commissioner's legally binding decision can only be set-aside or altered by the High Court - Prof. Wood did not follow this avenue as he knew he would fail.

I wrote to the Medical Council's president Prof. Wood setting matters out fully including the Information Commissioner's decision. I reiterated that they had materially altered my complaint and evidence by mis-describing and had presented my complaint and my evidence as the exact opposite to what I said.

In response it was denied that they had materially altered or misrepresented my complaint. This not just ensured their decision to clear Dr Noel stayed in place but covered up for the illegal and possible criminal activities and fabricated evidence.

This evidence proves beyond any doubt that Dr Noel was assisted by the Medical Council in covering up leaving me crippled - obviously Prof. Wood was making sure that they were not going to reinstate my complaint as their only aim was to clear Dr Noel no matter what the evidence. Such disreputable conduct puts Prof. Wood and Dr Noel on the same level as a common criminal.

Taking this in conjunction with Mr D. Coen's [their solicitor] stance that that their actions were fully within the law, it's very clear that Prof. Wood believes that, not only are they are above the law - they are the law and therefore completely unaccountable.

Medical Council's CEO Ms C. Spillane and solicitor Mr D. Coen aid the cover up:

Nearly two years before the Information Commissioner's decision I had made a formal complaint to Ms C. Spillane the CEO of the Medical Council regarding this allegation falsely attributed to me by the Medical Council, which materially altered my complaint, but she declined to accept my complaint.

Of note is that their solicitor, Mr D. Coen had earlier written to me insisting I'd made this allegation but declined to produce proof.

Obviously they were now not just covering up for Dr Noel but for possible criminal activity by the Medical Council - which would explain -

The Medical Council further aids Dr Noel's falsification of medical records:

Despite the documentary proof in their possession the Medical Council refused to accept my complaint that Dr Noel had falsified medical records.

As they had already materially altered my complaint / evidence in such a manner as to fit Dr Noel's falsification of medical records and falsehoods, they were obviously protecting not just Dr Noel but themselves and covering up for criminal activity.

Prof. A. E. (Freddie) Wood - A most dangerous hypocrite and charlatan:

What is quite clear is that the Medical Council's conduct was no mistake - but I'm left crippled for life, in much pain and mainly housebound.

He claims to promote patient safety, patient protection and care about the needs of patients - my case proves the opposite.

From what I've said and proven - Whether or not he was involved at the outset or his leadership encouraged matters, Prof. Wood and the Medical Council are not just aware of Dr Noel's activities, some criminal, but have actively aided it - further criminal activity. As Prof. Wood has proven himself to be thoroughly disreputable, what chance has any patient with such an amoral person as president of the Medical Council?

It's proven that Prof. Wood has total disrespect for the patient, for the courts, for the law and for the truth.

Also, Twice I asked Prof. Wood to assure me that no Council member who sat in judgement on my complaint had any connection in any way with Dr J. Noel - Prof. Wood refused by default, further showing his unbridled arrogance and lack of integrity.

Ms Helen Dixon deliberately breaks the law and helps cover-up criminal activity:

As detailed elsewhere - against my wishes Tallaght Hospital's CEO gave my full confidential file of 212 documents to a 3rd party. This contained a number of proven falsified documents / claims that were to aid the cover-up, including my falsified medical records.

The Data Protection Commissioner Ms Helen Dixon refused to accept my formal complaint indicating that such conduct would not breach Data Protection.

My complaint was absolutely proven, but Ms Dixon abused her position and authority in such a way that could only assist Tallaght Hospital and Dr Noel in their cover-up of crippling me for life.

Ms Dixon was also aware that very senior personnel would have their careers severely damaged by my complaint - clearly she saw her duty was to ensure that did not happen.

Medical records are the most sensitive and confidential documents and given that, any normal and reasonable person knows that releasing them against a person's wishes is a serious illegal act.

Therefore one can only reach the reasonable conclusion that Ms Dixon was fully aware of her actions and made a political decision based on 'who' was involved rather than the law she was obliged to follow.

One must ask who the favour was for when Ms Dixon decided to lose her profession integrity and act illegally - clearly she is unfit for the position she holds.

# An aside is that at times I've been given other patients private information.

Ombudsman Peter Tyndall - his malfeasance proven by the documents:

The evidence documents Mr Tyndall's twists and turns as he contradicts himself to support a cover-up.

First he says he will investigate my complaints, second he falsely says I've withdrawn my complaints, third he falsely says he investigated and had not upheld them, four he says he won't investigate them.

# The Ombudsman confirmed acceptance and that he would fully investigate my complaint against Tallaght Hospital [that would include examining Dr Noel's conduct].

# 10 months later he said he was closing the file as I'd withdrawn my complaints. I responded that I'd not withdrawn my complaints and expect his promised investigation.

He responded informing me he had now closed off my complaints as I've withdrawn them.

Mr Tyndall could not produce the legally required documentation, my withdrawal of my complaints, to support his false claim - so he just made up another false claim.

# I was informed that I'd been granted an 'appeal' against his decision not to up-hold my complaints.

Mr Tyndall could not produce the legally required documentation, his investigation and his notification to me of not up-holding my complaints - because they did not exist as there never was an investigation, so he was again caught in another false claim.

# Over a year after he had notified me of his 'full investigation' and having failed to get rid of me Mr Tyndall informed me that he would not investigate my complaints - Thereby covering-up for the people that have left me crippled and in pain for life and covering up possible criminal activity.

Just like the Medical Council, Tallaght Hospital and Dr Noel, Mr Tyndall was caught out by the documentary evidence, and like them he resorted to blatant falsehoods.

Denied treatment by HSE:

In 2014 HSE withdrew [claiming cutbacks] my transport so it was impossible for me to attend hospital appointments for treatment. When my G.P. and one of the consultants wrote to HSE ambulance service regarding this they were completely ignored.

The lack of treatment caused by this delay has left me irreparably damaged, with deteriorating mobility and health and in constant pain.


During 2015 it was suggested to me that the use of a wheelchair would possibly aid my degenerating mobility and I dismissed this as totally unacceptable not just because it would mean me losing my home, but because of how I came to be in my current state.
