Data Protection Commissioners manipulation:

Further covering-up for Tallaght Hospital by Ms H. Dixon. Evidence manipulated.

After over 4 years - No action to be taken - it's all a big mistake.

[My previous articles set out the details] The illegally released file contains hospital falsifications painting me as a time wasting patient who missed appointments who also refused treatment and those falsifications contradict original hospital documents. The falsifications passed the blame from the hospital on to me for my crippled state.

Now Ms Dixon's written statutory decision, although ruling in my favour, is nothing more than a propaganda document covering up the deliberate nature of the hospital's and in particular Ms E. Hardiman's law breaking, so as to not prosecute.

Ms Dixon's U-turn:

While this statutory decision records in different parts that my complaint had been made to the Data Protection Commissioner [D.P.C.] on 7th Dec 2012 and that D.P.C. investigation started on 23rd Sept 2016 there's no mention that this gap of nearly 4 years was caused by D.P.C. refusing my complaint insisting that the hospital had done no wrong in releasing my medical records, against my wishes, to outside third parties.

The rewriting of history:

The hospital has two sets of records - the earlier set supports my claims and puts the blame on to them. The second later set contradicts their early records and passes the blame on to me. Now the hospital avails themselves of Ms Dixon's statutory decision to further rewrite history to put themselves further in the clear.

Ms Dixon records that in December 2016 she outlined the preliminary findings of her investigation to me. All she told me was that the hospital had violated data law, there was absolutely nothing regarding the 'propaganda' below, so I had no opportunity to highlight the falsehoods as I've done here in this article - but from correspondence she must have been aware of them when making her decision.

All these 'facts' Ms Dixon records in her statutory decision make it out to be all a big mistake on the part of the hospital and Ms Hardiman. Everything was done for the best of intentions - so no prosecutions. But it's all based on these proven [by documentation] falsehoods etc. All a big mistake, while I'm left crippled for life and no action to be taken.

As I write this article I've been completely housebound for over a month and usually in considerable pain, yet the only actions I see are to cover-up.

During 2012 and in order not to answer my complaints and not to deal with me Tallaght Hospital, specifically the then CEO Ms E. Hardiman, deliberately broke the law and sent, against my wishes, my medical records to outside 3rd parties for 'review'.

Right up to present the hospital, specifically their present CEO Mr Slevin, refuse to answer my complaints on the grounds that an outside 3rd party is undertaking a full review based on the illegal release [unfair processing] of my medical records etc - Ms H. Dixon [D.P.C.] is aware of this and in fact refused my request that my illegally released records be returned to me by the 3rd parties.

For years the hospital and Ms Dixon have been fully aware that the law had been deliberately broken but Ms Dixon has and continues to abuse her authority to protect Ms Hardiman, Tallaght Hospital and staff.

Having refused to accept my complaint [made 2012] for 4 years with the ludicrous grounds that the hospital and Ms Hardiman had every right to pass my medical records etc to outside 3rd parties against my wishes and this had not violated the data laws - while the hospital and D.P.C. had agreed privately in 2012 that the hospital had broken the law.

[I wrote, for example, to D.P.C. in 2012 & 2013 regarding this but was totally ignored. Ignoring reasonable but awkward correspondence seems to be policy],

Ms Dixon, having been caught out did a U-turn, investigated my complaint and issued a statutory decision in March 2017.

Ms Dixon ruled that the hospital [Ms Hardiman] had broken the law as they had "no legal basis for disclosing your sensitive personal information" etc.

Despite this and having been given the proof that Ms Hardiman deliberately broke the law and the hospital was profiting [and still are] from the illegal acts [there can be no 'review' based on illegal acts] my request for prosecution was refused by default. Ms Dixon had at first denied she had the power to prosecute but under my pressure admitted she had.

Ms Dixon's statutory decision [she has refused any discussion]:

# She highlights my refusal of the hospitals apology - but says nothing about their refusal to rectify and answer my complaints or them still standing by their claim that there's an ongoing 'review' [based on the illegally released records] as a reason.

# She highlights the hospitals claim to have spent 2 years trying to resolve my complaint - but says nothing regarding them refusing to answer my complaints, both the 5 year old ones and more recent ones. Refusals based on the illegal release of my file.

# She says nothing and does nothing regarding the hospital continually profiting from their deliberate violation of the Data Protection Act.

Hiding the proof of Ms Hardiman's deliberate law breaking:

# Ms Dixon, while ignoring my request to prosecute and while acknowledging my claim that the violations of the Data Protection Act were deliberate [as opposed to the hospital's claim it was all a mistake], failed to record Ms Hardiman's two written requests to me for my explicit permission to release my records to outside 3rd parties for review [proving the deliberate nature of Ms Hardiman's actions].

This is very telling in the light of Ms Dixon being aware that the hospital's Ms Hardiman deliberately broke the law in releasing my medical records in order to disseminate proven false documents, and -

Non- existent 'notifications':

# Ms Dixon cites, more than once, that the hospital had written to me twice advising me that they would now be referring matters to outside 3rd parties for review. That's false - these notifications don't exist and I have asked Ms Dixon to produce these documents or to explain. So again we have documentation 'invented' to suit purpose - just like the Medical Council, who were forced to admit this via the Information Commissioner's legally binding statutory decision.

False claim that I never objected to my records being sent to outside 3rd parties:

# Ms Dixon records that I never objected to the hospital's [Ms Hardiman's] suggestion that they send my records to outside 3rd parties for review. That's false - as Ms E. Hardiman [then Tallaght Hospital CEO] personally wrote to me twice specifically requesting my permission to release my records and stating that once I'd given my consent she would recommend an outside 3rd party review of said records. Twice I wrote to Ms Hardiman declining to give my permission.

Ms Dixon fully accepts this falsehood to exonerate the hospital and Ms Hardiman of any deliberate intent.

I have asked Ms Dixon to inform me what she intends to do about these most serious matters and what rectification is to be offered to me.

Crippled for life due to negligence and falsification justified:

# Ms Dixon records that the hospital had released my confidential records to outside 3rd parties in order to care for my health and for openness and transparency.

# openness and transparency - D.P.C. is fully aware that Tallaght Hospital refused to give me a copy of the file they illegally released but lets the hospital's falsehood go as it paints them in a 'good' light.

# health - the hospital attempts to justify [illegally] releasing my file by saying, as recorded by Ms Dixon, it was their responsibility as a hospital to provide as far as possible for my health, happiness and welfare as a patient.

Yet they have left me crippled for life, falsified documentation [contradicting other hospital records] refused to answer my complaints and ignored my letters etc.

Ms Dixon is aware that the deliberate violations of the Data Protection Act was used to disseminate falsifications to 3rd parties For example, some of which helped Dr J. Noel deny the truth of his own letter and contradict what he had told my G.P. to cover-up for negligence that left me, a patient, crippled for life.

Looking at my longstanding and ongoing situation it's easy to see why our health service is so bad and getting worse - patients have no protection as hospitals and their staff etc are unaccountable, even to the extent that they can break the law and be covered-up for.

My complaints, original and others, remain unanswered - proving that Tallaght Hospital, their staff etc are unaccountable.

I'm left crippled for life, virtually housebound and in constant pain and all Ms Dixon can think of is to cover-up for the hospital, their staff and Ms E. Hardiman in particular.

I have offered Ms Dixon the opportunity to respond and substantiate the propaganda by sending her a link to my article.

Ms Dixon had and has the opportunity to respond, with evidence, if she believes anything I have published is incorrect or untrue.

Matters are so serious that if she does not avail of the opportunity it can only be accepted that she agrees with everything in this and other articles.

Tallaght Hospital CEO guilty of deliberately breaking the law:

Guilty - the official and legal verdict on Tallaght Hospital.

Data Protection Commissioner delivers her verdict 4 years after I made my complaint to her.

The Data Protection Commissioner has found Tallaght Hospital guilty of breaking the law by passing on my medical records [file of over 200 documents] to 3rd parties.

The Commissioner made two rulings -

# That the hospital had passed on my records to 3rd parties without my required consent and had therefore broken data protection law;

# That the Commissioner could not see any legal basis for passing on my file to 3rd parties.

This related to the then CEO of Tallaght Hospital, Ms E. Hardiman, personally orchestrating the releasing of my medical records to 3rd parties against my wishes.

This decision comes over 4 years after I made my complaint to the Commissioner.

Now under consideration is what action is to be taken regarding this deliberate violation of data protection law.

Medical Councils serious lack of integrity:

The Medical Council ~ investigation:

Dr Audrey Dillon. Medical Council Vice-President and Chair of Ethics and Professionalism Committee.    

I have now presented Dr A. Dillon with more than enough documentary evidence for to conduct an investigation and for full rectification including reinstatement of my complaints and further action against Tallaght Hospital's Dr J. Noel for his falsehoods etc made to the Council and also regarding the illegal and possibly criminal actions of the Council and, or their staff.

This included proof that the Council's solicitor Mr Diarmuid Coen had not just indulged in serious misconduct but on the face of it, criminal conduct. This was in relation to matters they were forced by the Information Commissioner to admit to after years - that they never had the evidence they claimed they had when clearing Dr Noel - in fact the evidence did not exist, they had fabricated it. Evidence Mr Coen fraudulently had insisted and certified they had in their possession.

Just one other matter is regarding the Council's acceptance of evidence regarding an incident from a Tallaght Hospital staff member who is proven was not on duty or even present in the hospital at the time of the incident.

I have also provided her with a link to this publication so that she's fully informed.

Tallaght Hospital to be investigated:

Data Protection Commissioner orders a formal investigation into Tallaght Hospital:

Over 4 years after ruling my complaint not valid the Commissioner now admits it's valid.

Quite perversely the notification of investigation informs me that "the investigation will endeavour to establish whether any contravention of the Acts occurred."

But the Commissioner has already told Tallaght Hospital that they did contravene the acts - My article 18th Aug 2016.

However -

So after over 4 years of my Rights being clearly denied to me, a fact that could only help those who have left me crippled for life, it's decided that my complaint was indeed valid [Without apology or explanation].

It has to be questioned why it has taken over 4 years to investigate what was clearly a valid complaint and why in the interim the Commissioner has treated me with such extreme discourtesy [Without apology or explanation], such as by ignoring the majority of my Emails, including - that Tallaght Hospital's data protection officer had ignored my formal complaints.

Of course it's not just a matter of illegally releasing my documents, but using the illegal release to disseminate false documents that would help a cover-up - false by virtue that later hospital documents were produce that contradict the earlier hospital documents that supported me.

The false documents are extremely important because they pass the blame onto me [from the hospital] for my crippled state.

Also my documents were accessed and released not by a doctor or for my treatment but by lay person[s] and that was personally instigated by Ms E. Hardiman.

The investigation must be wide ranging and cover the interval between my first complaint and the belated investigation - including all correspondence to Commissioner and that includes my complaint made 2 years ago regarding the illegal release of my medical records [proven to be falsified], a complaint that the Commissioner just ignored in order not to deal with it and that could only aid Tallaght Hospital's cover-up.

# I wrote directly to the Commissioner, Ms H. Dixon, regarding these two complaints but she completely ignored me.

Certain matters have already been settled [as shown in my previous articles] -

# Tallaght Hospital and in particular Ms E. Hardiman deliberately violated the Data Protection Act - as they were told by Commissioners in private conversations.

# Tallaght Hospital and in particular Ms E. Hardiman knew full well they needed my express permission and knew they did not have it.

# That my complaint made, over 4 years ago, to the Commissioner was in fact clearly valid.

# I have provided Mr John S. Keyes, Assistant Commissioner, the investigating officer, with a link to this article so that it will be taken into consideration.

Total indifference and possible criminal activity:

While you read this update and consolidation keep one thing in mind. Although it has happened to me - who's next? You? And where would you turn?

Dr J. Noel [MCRN 14671] criminally negligent by wantonly denying me treatment:  

A document that stayed hidden on Dr Jacques Noel's files for a considerable time shows that by Aug 2010 he was fully aware that I'd not had the urgent treatment he claimed he had ordered 5 months previously [on 1st April 2010] for me and he was going to check this out. At that point in time I was not yet in a crippled state.

9 months later in May 2011 he told the Medical Council that he had not made the promised checks to ensure that I had the urgently need treatment and that I'd still not had treatment. He said that the hospital had not made the booking he had requested over a year ago - this was accepted by the Medical Council despite me now being crippled with extremely limited mobility, virtually housebound and in constant pain.

What Dr Noel's own documentation proves is that he was fully aware for at least 9 months that I'd not had the urgently required treatment he had ordered but he had been too lazy to do anything about it.

Constructively or otherwise he had deliberately denied me treatment / medical assistance because of his laziness. It's also proven that he falsified documentation including medical records and in any normal society that would be a criminal offence.

This would explain the extraordinary conduct of those involved, who violated and denied me my legal Rights in order to cover up for him - especially the Medical Council, who, as proven by internal documents, materially altered my complaint and evidence putting Dr Noel in the clear.

While Dr Noel's early conduct deserved a sever reprimand, his subsequent conduct merits him been struck-off as a doctor. Simply Dr J. Noel is a danger to patients.

Tallaght Hospitals' CEO Mr D. Slevin is fully aware of, and indifferent to, the very serious problems regarding his hospital's mis-treatment of me. A coroner once said that Tallaght Hospital “sounds like a very dangerous place to be for anybody, let alone a sick patient”.

The early records of Tallaght Hospital completely agree with my version of events. At later dates they 'produced' records not just contradicting my version but contradicting their own earlier records.

Another example of attempts to further shift the blame ~ the hospital call me a liar saying that I did not, as I claimed, make the very important phone call to them. They base this on a statement from Dr Noel's secretary Irene Fortune saying she never spoke to me - this despite internal documents showing she was off sick the day I phoned. I taped my call and the person I spoke to never denied taking my call.

The Medical Council's falsification proven through the Information Commissioner:

After continually insisting that they had not materially altered my complaint and evidence and that I had made the allegation, it was recorded in the Information Commissioner's legally binding decision that the Medical Council could not produce any records to show that I had made the allegation they claimed I had and they admitted that I had not made the allegation they claimed I had and they acknowledged that they had incorrectly described my complaint.

A proven serious lack of professional integrity led by President Prof. F. Wood and possible criminal activity - What confidence can one have when a doctor can leave a patient crippled for life, lodge proven falsified records with the Medical Council who actively aid that doctor by manufacturing 'evidence' and altering complaints.

The letter Dr Noel had written at the consultation - the only one received by my G.P., the only one seen by the Medical Council and the only one then in existence - completely supported my complaint by confirming he had only offered me treatment ASAP depending on when a bed became available.

Dr Noel told the Medical Council that he wanted them to accept that this letter actually confirmed that he had offered me immediate treatment and I had refused his offer.

The Medical Council agreed and they materially altered my complaint, misrepresented my evidence and indulged in falsification and dismissed my complaints - thereby putting Dr Noel and Tallaght Hospital in the clear and blaming me for my crippled state.

It's quite clear that the Medical Council acted not just against public interest and quite possibly criminally - even though I'm left crippled for life and in constant pain.

Despite this, the Medical Councils decision to dismiss 'my' complaint and clear Dr J. Noel still stands and this is explained by -

Prof. A. E. (Freddie) Wood usurps the High Court and fabricates evidence to protect Dr Noel - putting both on the same level as a common criminal:

The stated law is that the Information Commissioner's legally binding decision can only be set-aside or altered by the High Court - Prof. Wood did not follow this avenue as he knew he would fail.

I wrote to the Medical Council's president Prof. Wood setting matters out fully including the Information Commissioner's decision. I reiterated that they had materially altered my complaint and evidence by mis-describing and had presented my complaint and my evidence as the exact opposite to what I said.

In response it was denied that they had materially altered or misrepresented my complaint. This not just ensured their decision to clear Dr Noel stayed in place but covered up for the illegal and possible criminal activities and fabricated evidence.

This evidence proves beyond any doubt that Dr Noel was assisted by the Medical Council in covering up leaving me crippled - obviously Prof. Wood was making sure that they were not going to reinstate my complaint as their only aim was to clear Dr Noel no matter what the evidence. Such disreputable conduct puts Prof. Wood and Dr Noel on the same level as a common criminal.

Taking this in conjunction with Mr D. Coen's [their solicitor] stance that that their actions were fully within the law, it's very clear that Prof. Wood believes that, not only are they are above the law - they are the law and therefore completely unaccountable.

Medical Council's CEO Ms C. Spillane and solicitor Mr D. Coen aid the cover up:

Nearly two years before the Information Commissioner's decision I had made a formal complaint to Ms C. Spillane the CEO of the Medical Council regarding this allegation falsely attributed to me by the Medical Council, which materially altered my complaint, but she declined to accept my complaint.

Of note is that their solicitor, Mr D. Coen had earlier written to me insisting I'd made this allegation but declined to produce proof.

Obviously they were now not just covering up for Dr Noel but for possible criminal activity by the Medical Council - which would explain -

The Medical Council further aids Dr Noel's falsification of medical records:

Despite the documentary proof in their possession the Medical Council refused to accept my complaint that Dr Noel had falsified medical records.

As they had already materially altered my complaint / evidence in such a manner as to fit Dr Noel's falsification of medical records and falsehoods, they were obviously protecting not just Dr Noel but themselves and covering up for criminal activity.

Prof. A. E. (Freddie) Wood - A most dangerous hypocrite and charlatan:

What is quite clear is that the Medical Council's conduct was no mistake - but I'm left crippled for life, in much pain and mainly housebound.

He claims to promote patient safety, patient protection and care about the needs of patients - my case proves the opposite.

From what I've said and proven - Whether or not he was involved at the outset or his leadership encouraged matters, Prof. Wood and the Medical Council are not just aware of Dr Noel's activities, some criminal, but have actively aided it - further criminal activity. As Prof. Wood has proven himself to be thoroughly disreputable, what chance has any patient with such an amoral person as president of the Medical Council?

It's proven that Prof. Wood has total disrespect for the patient, for the courts, for the law and for the truth.

Also, Twice I asked Prof. Wood to assure me that no Council member who sat in judgement on my complaint had any connection in any way with Dr J. Noel - Prof. Wood refused by default, further showing his unbridled arrogance and lack of integrity.

Ms Helen Dixon deliberately breaks the law and helps cover-up criminal activity:

As detailed elsewhere - against my wishes Tallaght Hospital's CEO gave my full confidential file of 212 documents to a 3rd party. This contained a number of proven falsified documents / claims that were to aid the cover-up, including my falsified medical records.

The Data Protection Commissioner Ms Helen Dixon refused to accept my formal complaint indicating that such conduct would not breach Data Protection.

My complaint was absolutely proven, but Ms Dixon abused her position and authority in such a way that could only assist Tallaght Hospital and Dr Noel in their cover-up of crippling me for life.

Ms Dixon was also aware that very senior personnel would have their careers severely damaged by my complaint - clearly she saw her duty was to ensure that did not happen.

Medical records are the most sensitive and confidential documents and given that, any normal and reasonable person knows that releasing them against a person's wishes is a serious illegal act.

Therefore one can only reach the reasonable conclusion that Ms Dixon was fully aware of her actions and made a political decision based on 'who' was involved rather than the law she was obliged to follow.

One must ask who the favour was for when Ms Dixon decided to lose her profession integrity and act illegally - clearly she is unfit for the position she holds.

# An aside is that at times I've been given other patients private information.

Ombudsman Peter Tyndall - his malfeasance proven by the documents:

The evidence documents Mr Tyndall's twists and turns as he contradicts himself to support a cover-up.

First he says he will investigate my complaints, second he falsely says I've withdrawn my complaints, third he falsely says he investigated and had not upheld them, four he says he won't investigate them.

# The Ombudsman confirmed acceptance and that he would fully investigate my complaint against Tallaght Hospital [that would include examining Dr Noel's conduct].

# 10 months later he said he was closing the file as I'd withdrawn my complaints. I responded that I'd not withdrawn my complaints and expect his promised investigation.

He responded informing me he had now closed off my complaints as I've withdrawn them.

Mr Tyndall could not produce the legally required documentation, my withdrawal of my complaints, to support his false claim - so he just made up another false claim.

# I was informed that I'd been granted an 'appeal' against his decision not to up-hold my complaints.

Mr Tyndall could not produce the legally required documentation, his investigation and his notification to me of not up-holding my complaints - because they did not exist as there never was an investigation, so he was again caught in another false claim.

# Over a year after he had notified me of his 'full investigation' and having failed to get rid of me Mr Tyndall informed me that he would not investigate my complaints - Thereby covering-up for the people that have left me crippled and in pain for life and covering up possible criminal activity.

Just like the Medical Council, Tallaght Hospital and Dr Noel, Mr Tyndall was caught out by the documentary evidence, and like them he resorted to blatant falsehoods.

Denied treatment by HSE:

In 2014 HSE withdrew [claiming cutbacks] my transport so it was impossible for me to attend hospital appointments for treatment. When my G.P. and one of the consultants wrote to HSE ambulance service regarding this they were completely ignored.

The lack of treatment caused by this delay has left me irreparably damaged, with deteriorating mobility and health and in constant pain.

During 2015 it was suggested to me that the use of a wheelchair would possibly aid my degenerating mobility and I dismissed this as totally unacceptable not just because it would mean me losing my home, but because of how I came to be in my current state.

Tallaght Hospital CEO Mr Slevin's falsehood:

Senior HSE officials' statement proves Tallaght Hospital CEO Mr Slevin's falsehood:

During July '14 and as an excuse not to investigate my complaint that his hospitals Dr J. Noel had falsified my medical records Mr Slevin had said he was awaiting the outcome of the ongoing HSE review of my complaint.

During Aug '14 I challenging his refusal and asked for details telling him that I knew of no such 'review' - he ignored me.

During Sept '14 Ms D. Keyes, Regional Manager Consumer Affairs, HSE Dublin Mid-Leinster formally and officially confirmed to me that there is no and never was any such review.

What has become clear is a policy at Tallaght Hospital to falsify and fabricate whatever puts them in the clear and this goes right to the top, to the CEO.

While I'm left crippled Mr Slevin's priorities are clearly to cover-up for his hospital and indulge in falsehoods. This shows contempt for patients who obviously come a distant second in priorities.

Tallaght Hospital's 'policy' of altering records:

Tallaght Hospital CEO Mr D. Slevin approves the falsification of medical records:

On 21st July 2014 I lodged a formal complaint with Mr D. Slevin the CEO of Tallaght Hospital.

My complaint was that the hospital's Dr J. Noel had falsified my medical records and the proof I lodged was the two contradictory documents signed by Dr Noel.

The first was dated the day of my consultation and confirmed to my G.P. the truth which was, that he had offered me treatment ASAP depending on when a bed became available - which never came about.

The second was dated 7 weeks later, in which Dr Noel now falsely claimed that at the consultation he had offered me immediate treatment which I had refused.

The first placed to blame / onus on the hospital, the second passed the blame on to me - this is very important as I'm left crippled.

Of note is that the second document appeared out of thin air over a year after its claimed date of writing.

On 29th July 2014 Mr Slevin refused to accept my complaint.

On 11th Aug 2014 I wrote to Mr Slevin challenging his refusal but he ignored me. This proves complete indifference by Mr Slevin to record tampering by his hospital.

A very important point is that Tallaght Hospital has already committed offences by deliberately releasing, against my wishes, my 'medical records' to third parties.

This and the falsification were just part of a hospital cover-up approved at the highest level.

Despite this extremely serious misconduct and against my expressly written instructions, the hospital insisted that I attend during Aug 2014 and see Dr Noel. I made Mr Slevin aware of this without interest being taken.

I have given Mr Slevin the opportunity to respond.

Medical Council tampers with evidence:

Statutory investigation proves the Medical Councils falsifications:

In 2011 after the Medical Council dismissed my complaint against Tallaght Hospital's Dr J. Noel I discovered, through Freedom of Information that the Council had falsified my complaint.

They had described and recorded my complaint as an allegation I had not made, an allegation that was the exact opposite to what I had alleged.

From 2011 to 2014 and despite the documentary evidence the Council insisted that I had made this allegation and refused any rectification. Two of the senior staff members involved were the Councils solicitor Mr D. Coen and the Councils CEO Ms C. Spillane.

During 2014 and under the pressure of the Information Commissioners investigation the Council admitted that I had not made the allegation they had said I had, admitted that they had described and recorded my complaint incorrectly and admitted that they could not produce any documentation that even suggested I had made the allegation.

So it was now proven that the 'allegation' was a total fabrication by the Council.

I wrote to the Council's president Prof. F. Wood and asked for full rectification - he showed no interest but thanked me for writing.

Under an Order from the Information Commissioner the Council informed me that the reason they had dismissed my complaint in 2011 was that it [the fabricated allegation] did not give cause for action to be taken.

I then lodged a formal complaint with Prof. F. Wood especially citing the Information Commissioners investigation decision/report - his response is awaited.

# During this period I lodged a further complaint with the Council against Dr J. Noel regarding the falsification of medical records and backed my complaint with conclusive documentary proofs - the Council refused to accept my complaint.

While I'm left crippled the Medical Council will go to any lengths, legal or otherwise, to protect Dr J. Noel.

Given the Council's conduct over the years in perpetuating this falsehood and fabrication one has to ask - how many times has the Council indulged in this type of conduct? And given Prof. Wood's disinterest - how many more times?

I have offered Prof. F. Wood the opportunity to respond.

Dr Jacques Noel - lazy and negligent:

Dr Jacques Noel falsifies medical records to cover his laziness and negligence:

[1] I state that on 1/4/10 Dr Noel offered me treatment ASAP - facet joint injections ASAP depending on when a bed became available, followed by back rehab and I was to think about surgery at a later date if necessary.

Dr Noel confirmed what I state, twice, by his letter dated 1/4/10 to and as received by my G.P. - it was written immediately after and on the day as the consultation of 1/4/10.

[2] Over a year later Dr Noel produced what he claimed was his transcript of the medical records for the 1/4/10 consultation. This transcript was claimed to have been written on 19/5/10 a few weeks after said consultation. In this he contradicted his letter of 1/4/10 to my G.P. and claimed he had offered me admittance to hospital the following day [2/4/10] for facet joint injections but that I refused.

Of note is the fact that this transcript appeared for the first time 12 months after it was supposedly written and had and was never released under any of my Freedom of Information requests.

To bolster this falsehood and supported by it Dr Noel stated to third parties -

"Mr Trent was offered immediate treatment by admission the next day and diagnostic/therapeutic injections in theatre." "This was offered to Mr Trent and he did indeed decline this offer." Also Dr Noel stated that all this was clearly confirmed in his letter dated 1/4/10 to my G.P. - which, of course, it was not.

While Dr Noel's falsehoods would be clear to anyone with a grain of honesty and integrity, he was obviously banking on matters being dealt with and accepted on the basis of who he was rather than on what the documented facts were and that people would have as little honesty, ethics and integrity as he himself exhibits.

The falsification moved the blame for the lack of treatment from Dr Noel and Tallaght Hospital to me.
