Tallaght Hospital CEO Mr Slevin's falsehood:

Senior HSE officials' statement proves Tallaght Hospital CEO Mr Slevin's falsehood:

During July '14 and as an excuse not to investigate my complaint that his hospitals Dr J. Noel had falsified my medical records Mr Slevin had said he was awaiting the outcome of the ongoing HSE review of my complaint.

During Aug '14 I challenging his refusal and asked for details telling him that I knew of no such 'review' - he ignored me.

During Sept '14 Ms D. Keyes, Regional Manager Consumer Affairs, HSE Dublin Mid-Leinster formally and officially confirmed to me that there is no and never was any such review.

What has become clear is a policy at Tallaght Hospital to falsify and fabricate whatever puts them in the clear and this goes right to the top, to the CEO.

While I'm left crippled Mr Slevin's priorities are clearly to cover-up for his hospital and indulge in falsehoods. This shows contempt for patients who obviously come a distant second in priorities.

Tallaght Hospital's 'policy' of altering records:

Tallaght Hospital CEO Mr D. Slevin approves the falsification of medical records:

On 21st July 2014 I lodged a formal complaint with Mr D. Slevin the CEO of Tallaght Hospital.

My complaint was that the hospital's Dr J. Noel had falsified my medical records and the proof I lodged was the two contradictory documents signed by Dr Noel.

The first was dated the day of my consultation and confirmed to my G.P. the truth which was, that he had offered me treatment ASAP depending on when a bed became available - which never came about.

The second was dated 7 weeks later, in which Dr Noel now falsely claimed that at the consultation he had offered me immediate treatment which I had refused.

The first placed to blame / onus on the hospital, the second passed the blame on to me - this is very important as I'm left crippled.

Of note is that the second document appeared out of thin air over a year after its claimed date of writing.

On 29th July 2014 Mr Slevin refused to accept my complaint.

On 11th Aug 2014 I wrote to Mr Slevin challenging his refusal but he ignored me. This proves complete indifference by Mr Slevin to record tampering by his hospital.

A very important point is that Tallaght Hospital has already committed offences by deliberately releasing, against my wishes, my 'medical records' to third parties.

This and the falsification were just part of a hospital cover-up approved at the highest level.

Despite this extremely serious misconduct and against my expressly written instructions, the hospital insisted that I attend during Aug 2014 and see Dr Noel. I made Mr Slevin aware of this without interest being taken.

I have given Mr Slevin the opportunity to respond.

Medical Council tampers with evidence:

Statutory investigation proves the Medical Councils falsifications:

In 2011 after the Medical Council dismissed my complaint against Tallaght Hospital's Dr J. Noel I discovered, through Freedom of Information that the Council had falsified my complaint.

They had described and recorded my complaint as an allegation I had not made, an allegation that was the exact opposite to what I had alleged.

From 2011 to 2014 and despite the documentary evidence the Council insisted that I had made this allegation and refused any rectification. Two of the senior staff members involved were the Councils solicitor Mr D. Coen and the Councils CEO Ms C. Spillane.

During 2014 and under the pressure of the Information Commissioners investigation the Council admitted that I had not made the allegation they had said I had, admitted that they had described and recorded my complaint incorrectly and admitted that they could not produce any documentation that even suggested I had made the allegation.

So it was now proven that the 'allegation' was a total fabrication by the Council.

I wrote to the Council's president Prof. F. Wood and asked for full rectification - he showed no interest but thanked me for writing.

Under an Order from the Information Commissioner the Council informed me that the reason they had dismissed my complaint in 2011 was that it [the fabricated allegation] did not give cause for action to be taken.

I then lodged a formal complaint with Prof. F. Wood especially citing the Information Commissioners investigation decision/report - his response is awaited.

# During this period I lodged a further complaint with the Council against Dr J. Noel regarding the falsification of medical records and backed my complaint with conclusive documentary proofs - the Council refused to accept my complaint.

While I'm left crippled the Medical Council will go to any lengths, legal or otherwise, to protect Dr J. Noel.

Given the Council's conduct over the years in perpetuating this falsehood and fabrication one has to ask - how many times has the Council indulged in this type of conduct? And given Prof. Wood's disinterest - how many more times?

I have offered Prof. F. Wood the opportunity to respond.

Minister Reilly untruthful in the Dail:

Minister Reilly refuses to protect vulnerable patients from abuse of their Rights:

After I had lodged a formal complaint with Minister Reilly and after he had investigated and after he had responded that he was completely satisfied with the Medical Council's conduct, Dail Questions were asked on my behalf, one of which was -

"Is the Minister aware of the misrepresentation of Mr Trent's case during a Medical Council investigation, the result of which the Minister stood over despite the documented evidence provided by the patient to the Council?"

The Minister responded by claiming that he was precluded by law from becoming involved or doing anything regarding the Medical Council. The Minister indicated that he had already responded to my complaint to him.

Clearly, and given his investigation of my formal complaint, his response that he is precluded is known to be incorrect.

Minister Reilly was fully aware that the law and relevant Act gave him full authority to intervene, hence his investigation.

No matter what, as the Minister for Health he would have a duty to ensure, on behalf of the people, that a statutory body acts in a legal manner when carrying out their duties and not break the law to protect a negligent doctor.

Dr Jacques Noel - lazy and negligent:

Dr Jacques Noel falsifies medical records to cover his laziness and negligence:

[1] I state that on 1/4/10 Dr Noel offered me treatment ASAP - facet joint injections ASAP depending on when a bed became available, followed by back rehab and I was to think about surgery at a later date if necessary.

Dr Noel confirmed what I state, twice, by his letter dated 1/4/10 to and as received by my G.P. - it was written immediately after and on the day as the consultation of 1/4/10.

[2] Over a year later Dr Noel produced what he claimed was his transcript of the medical records for the 1/4/10 consultation. This transcript was claimed to have been written on 19/5/10 a few weeks after said consultation. In this he contradicted his letter of 1/4/10 to my G.P. and claimed he had offered me admittance to hospital the following day [2/4/10] for facet joint injections but that I refused.

Of note is the fact that this transcript appeared for the first time 12 months after it was supposedly written and had and was never released under any of my Freedom of Information requests.

To bolster this falsehood and supported by it Dr Noel stated to third parties -

"Mr Trent was offered immediate treatment by admission the next day and diagnostic/therapeutic injections in theatre." "This was offered to Mr Trent and he did indeed decline this offer." Also Dr Noel stated that all this was clearly confirmed in his letter dated 1/4/10 to my G.P. - which, of course, it was not.

While Dr Noel's falsehoods would be clear to anyone with a grain of honesty and integrity, he was obviously banking on matters being dealt with and accepted on the basis of who he was rather than on what the documented facts were and that people would have as little honesty, ethics and integrity as he himself exhibits.

The falsification moved the blame for the lack of treatment from Dr Noel and Tallaght Hospital to me.

# the transcript was under the title:-

Mr Jacques Noel Consultant Orthopaedic Spinal & Paediatric Surgeon.

# was under three addresses;-

Suite 9, Sports Surgery Clinic, Santry, Demesne, Dublin 9.

Adelaide & Meath Incorporating National Children's Hospital, Tallaght, Dublin, 24.

Our Lady's Children's Hospital, Crumlin, Dublin, 12.

# was signed:-

Dr Jacques Noel. M. Med. Sc, M.Sc, F.R.C.S.I. (Tr. & Orth.) (N.M.C.M: 14671).

No patient protection in Ireland:

Stance of Minister Reilly, HSE and the Medical Council:

A major factor in my complaint to the Medical Council against Tallaght Hospital's Dr J. Noel was that on 1/4/10 he had offered me treatment ASAP depending on when a bed became available and that was confirmed in his letter of the same date to my G.P. and I lodged this letter as evidence - This was the only letter anyone saw.

Ms Finola O'Dwyer [a solicitor appointed by the Medical Council] presented my complaint and the opinion that no action be taken against Dr Noel. My complaint was dismissed.

After obtaining records under Freedom of Information etc I made a number of disturbing discoveries.

[1] Ms O'Dwyer had presented my complaint materially altered from what I had stated - Contradictorily it was claimed that I had stated that the letter from Dr Noel to my G.P. confirmed that on 1/4/10 Dr Noel had offered me immediate treatment but I'd refused his offer. This falsehood was confirmed in the Medical Council's minutes. No such letter from Dr Noel existed at this time.

My actual complaint as on the Medical Council's files was that, the claim that I'd been offered immediate admission and immediate treatment on 1/4/10 by Dr Noel was totally false and contradicted his letter to my G.P. of that date. Ms O'Dwyer presented me contradicting myself, my evidence and my complaint - therefore my complaint had to fail.

[2] That Dr Noel had written to the Medical Council saying he wanted his letter to my G.P. to be read as confirming that on 1/4/10 he had offered me immediate treatment by admission to hospital the next day [and not as was in his letter ~ treatment ASAP depending on when a bed became available].

Given the Medical Council is funded by the medical profession it's no surprise that they acceded to his most improper request. Dr Noel needed this to cover for the falsified medical records.

# Although I brought matters of grave concern to the attention of the Medical Council including CEO Ms Caroline Spillane and President Professor Kieran Murphy no interest was taken. In fact Mr Diarmuid Coen, solicitor, wrote to me insisting that this [falsification] was my complaint.

# Also and despite the absolute proof of their own minutes, Mr William Kennedy for the Medical Council denied what I claimed as per [1] above and passed his denial to very senior officials of the Dept' of Health APO Mr Pat Clifford and HEO Ms Joan McKenna and to the minister.

I brought this blatant false denial to Minister Reilly's attention and despite the documentary evidence, including the Council's own minutes he was not interested.

Given that the ample opportunities to admit mistake and to rectify were never taken, rather the opposite, the altering of my complaint must be considered deliberate.

Mr P. Tyndall Information Commissioner:

On 23rd July 2012 under Freedom of Information I requested the Medical Council to produce the documentation supporting their false claims of what they said I said. Although such documentation was required by law to exist as this was a statutory investigation, they refused to produce.

On 17th Sept 2012 I requested the Information Commissioner's assistance and although the Act etc says the intent was to finalise all requests within 4 months nothing has been done.

15 months later during Dec 2013 and after pressure from me I was told that the office was very busy and they would get around to my request when they could but did not know when.

Of note is, as previous shown in my blog, Mr Tyndall turns a blind eye to his staffs serious irregularities and improprieties including falsehoods that protected Tallaght Hospital etc.

Minister Reilly:

On 5/3/13 I made a formal detailed complaint, supported by documentary evidence to the Minister for Health Dr J. Reilly regarding the Medical Council's falsifications. At the end of July 2013 he responded that he was completely satisfied with the conduct of the Medical Council. I immediately sent him my objections in the form of a statement of record and asked he acknowledge that he had put it on the relevant file.

Minister Reilly totally ignored me.

On 3rd Dec 2013 under Freedom of Information I requested the minister/HSE to produce all records appertaining to my complaint of 5/3/13 and subsequent correspondence. In particular the document were its claimed I said that Dr Noel's letter to my G.P. confirmed that I was offered immediate treatment for my pain but had refused this offer - a document given the circumstances etc was required by law to exist.

On 23rd Dec 2013 Assistant Secretary Mr Paul Barron declined to produce the document.

Overall - While standing by their claim, all parties have refused to produce the document where they claim I made this statement. A statement that has me contradicting myself, my complaint and has me confirming and supporting Dr Noel's falsehoods. Falsehoods used to pass the blame from Dr Noel and Tallaght Hospital on to me and to dismiss my complaints.

No patient confidentiality in Ireland:

Date Protection Commissioner Hawkes rules a patient has no Rights to confidentiality for their medical records:

Ms Eilish Hardiman Tallaght Hospital's CEO released, to third parties, my file of personal information [containing about 200 documents]. This included a number of falsified documents including my medical records. Tallaght Hospital decline to give me a copy of said file.

By Email from and to her private Email address Ms Hardiman had twice requested my permission to make this release and twice in response I made it clear I was not giving my permission.

Despite this - late 2013 under Freedom of Information I received documentation from Tallaght Hospital which not only included my responses to Ms Hardiman's requests but an internal Email from her to Mr B. Carr stating that I'd never responded to her.

Mr Brendan Carr Tallaght Hospital's Data Protection Officer totally ignored me when I made a formal complaint to him regarding the illegal release of said file,

Mr Billy Hawkes the Data Protection Commissioner refused to take my complaint regarding these illegal acts stating that what I complained about would not be a breach of the Data Protection Act.

My original complaint commenced - "I wish to make a formal complaint regarding a serious breach of confidentiality by Tallaght Hospital in illegally releasing my personal information etc to other parties and also their Data Protection Officer ignoring my complaint. My complaint should also cover HSE. This refers to, at least, a file containing my information being released by Tallaght Hospital to HSE Advocacy without my requested permission."

[1] Upon receiving his refusal I wrote further to him highlighting a number of points including, again, that the hospital had twice requested my permission to release my personal information [file] to third parties and twice I did not give permission. However they still released said information, thereby deliberately breaking the law.

Mr Hawkes ignored me.

[2] During Sept 2013 I wrote to Mr Hawkes requesting prosecution of those involved.

Mr Hawkes ignored me.

[3] During Dec 2013 I wrote to Mr Hawkes in detail and requested that he formally explain, supported by the relevant law, his refusal to uphold and enforce Irish and EU law regarding my complaint.

Mr Hawkes ignored me.

Even though I'm now well into my 5th year of hell, left crippled with seriously impaired mobility all efforts are seemingly channelled into covering up negligence, indifference etc that has left my health destroyed.
